The Green Thumb Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Horreya LLC ("The Green Thumb," "we," "us," or "our") governing your use of the The Green Thumb mobile application (the "App"). Please read them alongside our Privacy Policy, which explains how we handle your data.

1. A quick summary

• The Green Thumb gives you AI-generated plant care guidance. It's a knowledgeable companion, not a professional or a substitute for expert judgment in situations that affect safety.
• The Green Thumb Pro is an auto-renewing subscription (Monthly or Annual) with a 7-day free trial. It renews automatically until you cancel, and you cancel in your Apple Account settings — not in the App. Full terms are in Section 4.
• Be respectful and lawful when using the App and the assistant. Don't misuse it.
• We provide the App "as is" and our liability is limited as described in Sections 8–9.
• We're based in Virginia and these Terms are governed by Virginia law (Section 10).

2. Acceptance of these Terms

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are using the App on behalf of yourself, you represent that you have the legal capacity to accept these Terms.

3. Description of the service

The Green Thumb helps you care for your plants using AI-generated guidance: plant identification, personalized care plans, task reminders, weather-aware adjustments, and an in-app assistant you can ask questions.

The Green Thumb is a horticultural guidance tool, not a professional service. The App's AI features generate horticultural suggestions based on the information you provide (including photos) and general plant-care knowledge. The Green Thumb does not employ licensed horticulturists, arborists, agronomists, or safety inspectors, and nothing in the App constitutes professional agricultural, horticultural, structural, or safety advice. See Section 6 for more on AI-generated output.

4. Accounts

• You may use parts of the App anonymously; some features (syncing your garden across devices, subscriptions, notifications) require creating an account with an email address and password.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• You may delete your account at any time in Settings → Delete account. See our Privacy Policy for what happens to your data when you do.
• We may suspend or terminate accounts that violate these Terms, misuse the App, or pose a security risk.

5. Subscriptions (auto-renewable)

The Green Thumb offers an optional paid tier, The Green Thumb Pro, sold as an auto-renewable subscription through the Apple App Store. By starting a trial or purchasing a subscription, you agree to the following:

• Plans and pricing. The Green Thumb Pro is offered as a Monthly subscription at $6.99 or an Annual subscription at $39.99 (U.S. pricing; local pricing may vary by territory and currency, as shown at checkout). Prices are subject to change; we will provide notice before any change takes effect for existing subscribers, as required by Apple and applicable law.
• Free trial. New subscribers receive a 7-day free trial on either plan. You will not be charged during the trial. If you purchase or upgrade your subscription while a free trial is active, any unused portion of the free trial is forfeited at the moment of purchase.
• Payment and auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase (or at the end of the trial period, if applicable). Your subscription automatically renews for the same plan length and at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing or cancelling. Subscriptions are managed entirely through your Apple Account settings (Settings → [your name] → Subscriptions on your device). The Green Thumb does not have the ability to cancel your subscription or issue refunds directly — that is handled by Apple in accordance with Apple's terms and applicable law. Deleting the App does not cancel your subscription.
• No proration on cancellation. If you cancel, you'll continue to have access to Pro features through the end of the period you already paid for; we do not provide partial refunds for unused time within a paid period.
• Restoring purchases. If you reinstall the App or use a new device, use Restore Purchases in Settings to reconnect an active subscription to your account.

6. AI-generated output; no professional or safety-critical reliance

The Green Thumb's plant identification, care plans, and assistant responses are generated by artificial intelligence based on the information you provide and general horticultural data. AI output can be incomplete, outdated, or wrong. You acknowledge and agree that:

• AI-generated guidance is offered for general informational and educational purposes only, to help you care for your own plants;
• it is not professional horticultural, agricultural, arborist, structural, or safety advice, and should not be relied upon for decisions involving personal safety, property damage, food safety (e.g., identifying edible vs. toxic plants for consumption), or situations requiring a licensed professional;
• you are responsible for exercising your own judgment, verifying important information independently, and consulting a qualified professional where the stakes warrant it; and
• The Green Thumb is not responsible for outcomes resulting from your reliance on AI-generated output.

7. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• attempt to reverse-engineer, decompile, or extract the App's underlying models, prompts, or source code, except as permitted by law;
• use the App to generate, upload, or transmit content that is abusive, harassing, hateful, infringing, or otherwise harmful;
• attempt to disrupt, overload, or gain unauthorized access to the App or its underlying infrastructure;
• use automated means (bots, scrapers) to access the App except as we expressly permit; or
• misrepresent your identity or impersonate another person.

We may suspend or terminate access for violations of this section.

8. Intellectual property

The App, including its design, code, text, graphics, and the The Green Thumb name and logo, is owned by Horreya LLC or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms. You retain ownership of the content you submit (your plant photos, notes, and questions), and you grant us a license to use that content solely to operate and improve the App as described in our Privacy Policy.

9. Disclaimer of warranties

THE APP AND ALL CONTENT AND GUIDANCE PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that AI-generated guidance will be accurate, complete, or suitable for your specific plants, climate, or circumstances.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Horreya LLC AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or any loss of plants, property, data, goodwill, or profits, arising out of or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms or the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, regardless of your country of origin or where you access the App. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice in the App (for example, before your next subscription renewal). Your continued use of the App after an update means you accept the revised Terms.
